Fibre To The Ground (FTTG)

1. Purpose of this Policy

This Acceptable Use Policy (“AUP”) governs the acceptable and prohibited use of Fibre To The Ground (“FTTG”, “we”, “us”, “our”) internet services, network, systems, and infrastructure. The purpose of this policy is to:

• Protect the integrity, performance, and security of the FTTG network.
• Ensure fair and lawful use of services by all customers.
• Comply with applicable South African laws and regulations By using FTTG services, you (“the customer”, “user”, “you”) agree to comply with this AUP.

2. Scope of Application

This AUP applies to:

• All FTTG customers and users.
• All internet services, accounts, and packages provided by FTTG.
• Any device, system, or application connected to the FTTG network This policy applies regardless of whether the service is used for personal, business, or commercial purposes.

3. Lawful Use Requirement

FTTG services may only be used for lawful purposes. Users must comply with:

• All applicable South African laws and regulations.
• International laws where applicable.
• Industry standards and best practices Any use of the service that violates the law is strictly prohibited.

4. Prohibited Activities

The following activities are expressly prohibited and constitute a material breach of this AUP:

4.1 Illegal Activities

• Engaging in or facilitating criminal activities.
• Fraud, identity theft, or financial crimes.
• Distribution or access to illegal content.

4.2 Network Abuse

• Activities that disrupt, degrade, or impair network performance.
• Excessive or abusive usage that negatively affects other users.
• Intentional congestion, flooding, or denial-of-service activities.

4.3 Security Violations

• Unauthorised access to systems, networks, or data.
• Hacking, probing, scanning, or penetration attempts.
• Circumventing security or authentication measures.

4.4 Malware and Harmful Content

• Creating, distributing, or hosting viruses, malware, ransomware, or spyware.
• Operating botnets or command-and-control services.

4.5 Spam and Unsolicited Communications

• Sending unsolicited bulk messages (spam).
• Operating open mail relays or message flooding services.
• Phishing or deceptive communications.

4.6 Copyright and Intellectual Property Infringement

• Unauthorised downloading, sharing, or distribution of copyrighted material.
• Circumventing digital rights management (DRM) systems.

4.7 Resale and Unauthorised Commercial Use

• Reselling or redistributing services without written approval from FTTG.
• Operating shared or public access services in violation of service terms.

5. Fair and Responsible Use Customers must use FTTG services responsibly and in a manner that does not:

• Harm the network.
• Inconvenience other users.
• Create legal or reputational risk for FTTG FTTG reserves the right to implement traffic management measures to maintain network stability.

6. Customer Equipment and Security

Users are responsible for:

• Securing their devices and networks.
• Ensuring equipment connected to the FTTG network does not introduce security risks.
• Preventing unauthorised access to their connection FTTG is not responsible for security breaches arising from customer equipment or negligence.

7. Monitoring and Enforcement FTTG reserves the right, subject to applicable law, to:

• Monitor network traffic for operational, security, and compliance purposes.
• Investigate suspected breaches of this AUP.
• Cooperate with law enforcement or regulatory authorities when legally required FTTG does not actively monitor content but may take action where abuse is detected.

8. Sanctions and Corrective Action

In the event of a breach of this AUP, FTTG may take one or more of the following actions without prior notice, depending on severity:

• Issue warnings or notices.
• Apply traffic shaping or bandwidth.
• Temporarily suspend services.
• Terminate services permanently.
• Report unlawful activities to relevant authorities Sanctions are applied proportionally and at FTTG’s discretion.

9. Liability and Indemnity

FTTG shall not be liable for losses arising from enforcement actions taken in terms of this AUP. You agree to indemnify and hold FTTG harmless against any claims, damages, or legal costs arising from:

• Your breach of this AUP
• Unlawful or abusive use of services

10. Amendments

FTTG may amend this Acceptable Use Policy at any time. Updated versions will be published on the FTTG website and take effect upon publication. Continued use of services constitutes acceptance of the amended policy.

11. Governing Law

This AUP is governed by the laws of the Republic of South Africa, and disputes shall be subject to the jurisdiction of South African courts.
