Fibre To The Ground (FTTG)

  1. Best-Effort Service Basis

All services provided by Fibre To The Ground (“FTTG”, “we”, “us”, “our”) are delivered on a best-effort basis. While FTTG endeavours to provide reliable and high-quality internet connectivity, uninterrupted or error-free service cannot be guaranteed. Actual service performance may vary due to factors including, but not limited to, network demand, infrastructure limitations, geographic location, and technical constraints.

 

  1. Service Speeds and Performance

Advertised speeds represent maximum achievable speeds under optimal conditions and are not guaranteed at all times. Actual throughput, latency, and performance may fluctuate depending on:

 

  • Network congestion.
  • End-user equipment and internal wiring.
  • Distance from network infrastructure • Usage patterns and peak-time demand FTTG shall not be liable for variations in speed that fall within reasonable operational parameters.

 

  1. Planned Maintenance

FTTG may conduct planned maintenance, upgrades, or system improvements from time to time to ensure network stability and performance. Such maintenance may:

 

  • Temporarily affect service availability or performance.
  • Be scheduled during off-peak periods where reasonably possible FTTG will make reasonable efforts to notify customers of planned maintenance in advance, where practical.

 

  1. Unplanned Outages and Faults

Unplanned service interruptions may occur due to unforeseen circumstances, including:

 

  • Network faults.
  • Equipment failures.
  • External interference or damage FTTG will use reasonable efforts to restore services as soon as practicable but does not guarantee fault resolution timeframes unless explicitly agreed otherwise.

 

  1. Third-Party Dependencies

FTTG services rely on third-party infrastructure and service providers. As a result, service availability may be affected by factors outside FTTG’s direct control, including:

 

  • Fibre network operator outages or faults.
  • Power supply interruptions, load-shedding, or electrical failures.
  • Infrastructure damage, theft, or vandalism.
  • Failures of upstream service providers FTTG shall not be held responsible for delays or service interruptions arising from such third-party dependencies.

 

  1. Force Majeure

FTTG shall not be liable for service interruptions or failures caused by events beyond its reasonable control, including but not limited to:

 

  • Natural disasters • Acts of government or regulatory authorities.
  • Industrial action or labour disputes • War, civil unrest, or national emergencies.

 

  1. Limitation of Liability

To the fullest extent permitted by law, FTTG shall not be liable for:

 

  • Indirect or consequential losses • Loss of profits, revenue, or business opportunities
  • Loss of data arising from service interruptions Nothing in this policy limits liability where such limitation is prohibited under South African law.

 

  1. Relationship to Other Policies

This policy must be read in conjunction with:

  • Terms of Use
  • Fair Usage Policy
  • Acceptable Use Policy Together, these policies form the basis of the service relationship between FTTG and its customers.

 

  1. Amendments

FTTG reserves the right to amend this Service Availability & Limitations policy at any time. Updated versions will be published on the FTTG website and take effect upon publication.
